PLEASE READ THIS TERMS OF SERVICE AGREEMENT CAREFULLY. BY ACCESSING THIS PLATFORM OR PURCHASING PRODUCTS AND SERVICES THROUGH IT, YOU AGREE TO BE BOUND BY ALL TERMS AND CONDITIONS OUTLINED IN THIS AGREEMENT.

This Terms of Service Agreement (the “Agreement”) governs your use of the website www.sparxlight.com, its associated mobile applications, and social media profiles (the “Platform”), as well as the products and services offered for purchase through Sparxlight.com, a division of Infureka Technologies Pvt. Ltd. (“Sparxlight.com”).

This Agreement incorporates by reference the policies and guidelines provided below. Sparxlight.com reserves the right to amend or modify the terms of this Agreement at any time by posting updates or revisions on the Platform.

You will be notified of any changes by the updated date being shown at the top of the Agreement. Any revised Agreement will take effect immediately upon being posted on the Platform. Continuing to use the Platform after such changes indicates your acceptance of the updated terms.

We encourage you to review this Agreement regularly to stay informed about the terms and conditions governing your use of the Platform. This Agreement does not change or replace any separate written agreements you may have with Sparxlight.com for other products or services. If you disagree with this Agreement (or any referenced policies or guidelines), please cease using the Platform immediately.

I. Membership Eligibility
The Sparxlight.com Platform is only available to individuals or entities that are capable of entering into legally binding contracts under applicable law. Therefore, if you are under 18 years old, you are not permitted to use or make transactions on this Platform.

II. Products and Services Terms of Offer
Sparxlight.com serves as an online marketplace offering “Experiences,” which are specific products and services bundled together, marketed, and sold through the Platform. To provide a wide range of Experiences, Sparxlight.com collaborates with various vendors and service providers. By placing an order for an Experience via Sparxlight.com, you agree to the terms outlined in this Agreement.

III. Communication
By using this Platform, you consent to receive communications from Sparxlight.com and its employees or affiliates through email, SMS, electronic alerts, and phone calls. These communications may include, but are not limited to, updates, reminders, and requests for feedback.

IV. Customer Solicitation
Unless you inform Sparxlight.com’s sales representatives during their call that you wish to opt out of future communications, you agree to continue receiving emails, notifications, messages, and calls from Sparxlight and its designated in-house or third-party communication teams. To opt out:

V. Proprietary Rights
Sparxlight.com owns the proprietary rights and trade secrets related to the Experiences, products, and goods it sells. You may not copy, reproduce, resell, or redistribute any Experiences, products, or goods created and/or distributed by Sparxlight.com. Additionally, Sparxlight.com holds rights to all trademarks, trade dress, and specific designs on this website, including text placement, images, calls to action, and other visual or informational content.

VI. Sales Tax; Service Tax
If you purchase any Experiences through the Platform, you will be responsible for paying any applicable sales tax and service tax.

VII. Platform Content; Intellectual Property; Third-Party Links
In addition to offering Experiences, the Platform also provides information and marketing materials, which may come directly from Sparxlight.com or from third-party websites. Sparxlight does not always create the content on this Platform, as some information is sourced from other places. Content created by Sparxlight is protected by intellectual property laws in India, internationally, and under foreign laws. Unauthorized use of this material may infringe copyright, trademark, and other laws. You agree to use the content on the Platform for personal, non-commercial purposes only. Any third-party links provided are for your convenience; Sparxlight does not endorse these websites and is not responsible for any damage or harm that may result from accessing or relying on them.

VIII. Use of Platform
Sparxlight.com is not responsible for any damages arising from the use of this Platform. You agree to use the Platform only for lawful purposes and not to:

• Violate any local, state, national, or international laws, including those related to intellectual property.
• Disrupt or interfere with others’ use of the Platform.
• Resell material from the Platform.

Posting
By posting content on the Platform, you grant Sparxlight.com a perpetual, worldwide, non-exclusive, royalty-free, transferable license to use, copy, display, perform, create derivative works from, and distribute such content in any medium, anywhere in the world. Sparxlight.com does not control user-generated content and is not responsible for any harm arising from interactions between users or posted content. Sparxlight reserves the right, but is not obligated, to monitor and remove content at its discretion.

XI. User Accounts; Promotions
Sparxlight reserves the right to collect user data such as name, contact details, and location information to facilitate Experiences or use of the Platform. Misuse or misrepresentation of this data may result in the suspension of services or termination of your account. Promotional discounts, offers, and accumulated rewards points may be revoked if suspicious activity is detected. If Sparxlight cannot verify your identity through valid contact information, your account may be suspended without liability for the company.

The Company may terminate your Experience bookings at any time without providing a reason. Sparxlight encourages users to take full responsibility for their personal items during Experiences. Although Sparxlight will make a best-effort attempt to locate lost items, it is not responsible for lost or damaged items.

Payment
Sparxlight facilitates online payments but is not responsible for any loss or damage arising from issues such as unauthorized transactions, payment limits, or declines due to transaction errors. Sparxlight is not a financial institution and does not assume fiduciary responsibility for the payment process.

X. Disclaimer of Warranties
YOUR USE OF THIS PLATFORM AND/OR EXPERIENCES IS AT YOUR OWN RISK. THE PLATFORM AND EXPERIENCES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” SPARXLIGHT DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT REGARDING THE EXPERIENCES OR PLATFORM CONTENT, OR ANY USE OR RELIANCE UPON SUCH CONTENT OR EXPERIENCES.
